1. Permission to Access Property

The Property Owner grants the Photographer limited, non-exclusive access to the property located at 170 John Maxwell Dr., Hendersonville, NC 28792 on a mutually agreed-upon date for the purpose of conducting a photo session.

2. Payment Terms

The Photographer agrees to pay a property use fee, to be confirmed prior to booking. This fee grants use of designated areas for a set period of time, within specific hours agreed upon in advance. Payment is due prior to or upon arrival.

3. Use of Photographs

The Photographer grants the Property Owner a non-exclusive, royalty-free license to use selected photographs taken on the property for promotional purposes, including but not limited to the website, social media, print advertising, and marketing materials.
• The Property Owner will credit the Photographer when reasonably possible.
• The Photographer retains copyright and ownership of all original images.

4. Client & Photographer Conduct

The Photographer agrees to the following conditions:
• All clients must be supervised by the Photographer at all times.
• No structures, furniture, or plants may be moved without permission.
• No littering, smoking, or alcohol is permitted on the property.
• Photographer and clients must remain within the approved areas and respect all marked boundaries.
The Property Owner reserves the right to terminate the session without refund if any conduct is deemed unsafe or damaging to the property.

5. Rescheduling & Cancellation

Sessions may be rescheduled due to inclement weather or emergency with at least 24 hours’ notice. Cancellations made less than 48 hours in advance may result in forfeiture of the session fee at the discretion of the Property Owner.

1. Acknowledgment of Risks

Visitors understand and acknowledge that accessing and participating in activities on the property may involve inherent risks, including but not limited to:
• Slips, trips, and falls on uneven or natural terrain
• Exposure to wildlife or insects such as bees, ticks, or snakes
• Contact with poison ivy, poison oak, or other allergenic plants
• Weather-related risks (e.g., sun exposure, heat exhaustion, storms)
• Use of outdoor equipment or participation in physical activities

By entering the property, visitors voluntarily assume all such risks, including the potential for physical injury, illness, allergic reaction, or other harm.

2. Waiver and Release of Liability

In consideration of being granted access to the property or participating in any related activities, all visitors agree to release and hold harmless The Maxwell Estate and Vicon Property Group, including their owners, employees, agents, and affiliates (collectively referred to as the “Released Parties”), from any and all liability, claims, or causes of action resulting from injury, illness, or damages arising from their presence or participation, whether due to negligence or otherwise.

3. Medical Treatment Authorization

In the event of a medical emergency, visitors authorize the Released Parties to seek medical assistance as deemed necessary. Visitors agree to accept full financial responsibility for any resulting medical expenses.

4. Photography Consent (Optional)

Unless otherwise stated, visitors grant permission for photographs or videos taken on the property to be used for promotional or marketing purposes by the property owners or affiliates, without expectation of compensation.

5. Legal Age and Responsibility

By entering the property, visitors confirm they are at least 18 years of age and legally competent to agree to these terms. If accompanying a minor, the adult affirms they are the parent or legal guardian and accept these terms on the child’s behalf.
